Terms and Conditions

1. Acceptance and Binding Agreement

These Terms and Conditions form a binding agreement governing access to and use of E-Safe. By visiting the website, creating or using an account, acknowledging the Terms during registration or login, submitting information, using a member feature, or otherwise using a Service, a user agrees to these Terms and the Privacy Policy.

A person who does not agree must not create an account, submit information, or use a restricted Service. Access to public information without an account is also subject to the provisions that reasonably apply to visitors, including disclaimers, intellectual-property rules, prohibited conduct, governing law, venue, and limitations of liability.

2. Companion Documents and Order of Control

These Terms and the Privacy Policy are companion documents and must be read together. The Privacy Policy controls how E-Safe collects, uses, displays, retains, shares, secures, and deletes Personal Information. These Terms control access to and use of the website, accounts, User Content, conduct, disclaimers, liability, suspension, termination, and disputes.

The documents are intended to operate consistently. If an apparent conflict cannot reasonably be reconciled, the Privacy Policy controls only the handling of Personal Information, these Terms control only website use and disputes, and applicable law controls over both.

3. Identity and Nature of E-Safe

E-Safe is the name of a privately owned and privately operated community information website and public-service project available at https://e-safe.us. It is funded by a private individual, is provided without charge to the public, and is not operated as a commercial service. References to “E-Safe,” “we,” “us,” or “our” mean the website, its individual owner and operator, and authorized administrators acting for the website.

E-Safe is not a law enforcement agency, government department, emergency response service, medical provider, financial adviser, investment adviser, broker, fiduciary, law firm, the United States Department of Veterans Affairs, the Georgia Bureau of Investigation, the United States Department of Homeland Security, or the federal employment eligibility E-Verify program. E-Safe does not represent that it is a nonprofit corporation or tax-exempt organization.

4. Eligibility and Authority

Accounts are not intended for children under 13. A person under 13 may not create an account or submit Personal Information through E-Safe. A person who is 13 through 17 may use E-Safe only with the permission and supervision of a parent or legal guardian. A parent or guardian who permits use accepts responsibility for that minor's activity to the extent allowed by law.

A person using E-Safe for a business, association, household, organization, or other person represents that the person has authority to submit the information and accept these Terms for the relevant use. A user may not impersonate another person or falsely claim authority.

5. Accounts, Registration, Login, and Security

A user must provide accurate, current, and complete information and must keep account information reasonably current. Usernames and designated profile fields may be visible to others. Users must not use an email address, telephone number, exact home address, credential, or other sensitive information as a public username.

A user is responsible for safeguarding credentials, devices, sessions, and account recovery methods and for activity occurring through the account, except to the extent caused solely by E-Safe's proven misconduct. Accounts may not be sold, transferred, shared, or used to conceal another person's identity without written authorization.

A user must promptly notify E-Safe of suspected unauthorized access. E-Safe may require a password reset, verification, access restriction, or other security measure and may refuse a registration or login when reasonably necessary to protect the website or users.

6. Services

E-Safe may provide public information, community news, safety awareness, alerts, missing-child information, GBI unsolved-case information, AirNow AQI information, veterans resources, events, directories, business verification, HOA information, investment and TSP information, lost and found pet reports, chats, messages, polls, groups, member pages, profiles, posts, comments, photographs, appointments, subscriptions, searches, administrative review, and other community tools.

Services, sources, availability, geographic coverage, access requirements, and features may change at any time. E-Safe may add, modify, restrict, suspend, replace, or discontinue any feature without creating a duty to continue it. Registered access is a revocable privilege, not a property right.

7. No Emergency, Official Reporting, or Government Action

E-Safe is not an emergency reporting channel. Do not use E-Safe to report a crime in progress, active threat, fire, medical emergency, missing child, benefits emergency, or other urgent matter. Call 911 or contact the responsible authority directly.

Do not submit official tips, evidence, claims, benefit applications, appeals, police reports, public-record requests, or case actions to E-Safe. Use the official contact information or source link displayed for the responsible agency. Sending information to E-Safe does not provide notice to any government agency, preserve a deadline, initiate an investigation, create a case, or satisfy a legal filing requirement.

8. User Content and Public Visibility

“User Content” means information, text, messages, votes, poll responses, comments, photographs, files, reports, directory entries, business information, event information, links, notes, and other material a user submits, uploads, sends, publishes, or makes available through E-Safe.

A user retains any ownership rights the user lawfully holds in User Content. By submitting User Content, the user grants E-Safe a nonexclusive, worldwide, royalty-free, transferable and sublicensable license, limited to operating, securing, moderating, formatting, reproducing, displaying, distributing, communicating, archiving, backing up, and promoting the E-Safe Services and the submitted content. This license continues while the content remains on the website and afterward only to the extent reasonably necessary for backups, shared copies, legal compliance, security, evidence, or content already incorporated into another user's lawful activity.

A user represents and warrants that the user owns or has all rights, permissions, and lawful authority needed to submit the User Content and grant this license; that the content is not knowingly false, fraudulent, defamatory, infringing, unlawfully discriminatory, threatening, harassing, obscene, exploitative, or privacy-invasive; and that publication will not violate a contract, court order, law, confidentiality duty, intellectual-property right, publicity right, or another person's reasonable privacy.

Information entered in a public field may be displayed, copied, indexed, shared, printed, archived, or captured by others. E-Safe cannot control information after another person or service lawfully receives or copies it. Restricted groups and private messages reduce intended visibility but are not guaranteed confidential, privileged, encrypted end to end, or immune from authorized administrative or legal access.

9. Moderation and Editorial Control

E-Safe has no obligation to prescreen, monitor, verify, publish, preserve, or respond to User Content. E-Safe may review, edit for formatting or safety, label, restrict, move, reject, remove, archive, disable, or disclose content when reasonably believed necessary to enforce these Terms, protect users, preserve source integrity, respond to complaints, comply with law, or operate the Services.

Moderation decisions may be made without advance notice. E-Safe is not required to provide an appeal, explanation, backup copy, or compensation. Failure to remove particular content does not mean E-Safe approves, adopts, verifies, or assumes responsibility for it. E-Safe reserves all protections available under applicable law for third-party content and good-faith moderation.

10. Prohibited Conduct

A user may not use E-Safe to violate law or another person's rights; submit false, fraudulent, misleading, defamatory, threatening, harassing, hateful, exploitative, obscene, sexually explicit, or violent content; dox, stalk, intimidate, or reveal private information; impersonate another person; submit another person's Personal Information without lawful authority; exploit or endanger a minor; interfere with an investigation; solicit unlawful activity; infringe intellectual property; transmit malware; probe or bypass security; scrape or harvest data without written permission; overload the website; automate registrations or messages; send spam; manipulate polls; create deceptive accounts; evade a suspension; misuse official seals or records; or use information to discriminate, retaliate, threaten, or cause harm.

A user may not treat E-Safe data as a replacement for official records or use it to make a high-impact decision concerning employment, housing, credit, insurance, medical treatment, legal rights, benefits, public safety, or eligibility without independently verifying the information through authoritative sources and complying with applicable law.

11. Service-Specific Disclaimers

Public safety, active-shooter, emergency, weather, FEMA, NOAA, NWS, GBI, BOLO, and lookout information may be delayed, incomplete, changed, withdrawn, or inaccurate. Users must follow official instructions and use official reporting channels.

Missing-child information is public-awareness content obtained from recognized sources. E-Safe does not investigate cases, accept tips, confirm current status, or guarantee that a record remains active. Contact the official agency or National Center for Missing & Exploited Children source directly.

Lost and found pet reports are user-submitted community notices. E-Safe does not verify ownership, identity, condition, location, safety, or outcome and does not guarantee recovery. Users must use caution when meeting strangers, exchanging an animal, or publishing contact and location information.

AirNow AQI and other environmental information are informational and may be delayed or location-limited. They are not medical advice, diagnosis, treatment, or an emergency warning. People with health concerns should consult official health guidance and a qualified medical professional.

Veterans and VA information is informational. E-Safe is not affiliated with the Department of Veterans Affairs, does not access or decide claims, and does not provide accredited representation, medical advice, legal advice, or benefit determinations.

Investment Monitor and TSP Fund Monitor information is educational and informational only. It may be delayed, incomplete, or inaccurate and is not investment, financial, tax, retirement, fiduciary, or trading advice. E-Safe does not execute trades, access brokerage or TSP accounts, guarantee performance, or recommend that any person buy, sell, hold, or transfer an asset.

HOA covenants, community records, directories, business records, licenses, insurance information, and verification results may be incomplete, expired, changed, or subject to interpretation. They are not legal advice, title evidence, regulatory approval, certification by a government, or a guarantee of performance, safety, honesty, solvency, licensure, insurance, or suitability.

E-Safe Tools • E-Verify is an E-Safe community business-verification tool. It is not connected with the federal employment eligibility E-Verify program and may not be used to establish work authorization, immigration status, legal compliance, or government approval.

News, events, directories, appointments, groups, polls, chats, and community posts may contain third-party or user-supplied information. An inclusion, link, listing, rating, appointment option, or verified status is not an endorsement, warranty, partnership, professional engagement, or guarantee.

AI-assisted content may be incomplete, inaccurate, outdated, biased, or fabricated. Users must independently verify AI-assisted output. No confidential, medical, financial, legal, credential, or other sensitive information should be entered into an AI feature.

12. Intellectual Property

Except for User Content and third-party material, the E-Safe website design, original text, graphics, compilations, organization, code, logos, names, and other original material are owned by or licensed to E-Safe and are protected to the extent provided by law. No right is granted except the limited right to access and use the Services in accordance with these Terms.

Government works, public records, publisher content, trademarks, logos, photographs, source data, and linked material remain subject to the rights and terms of their respective owners. E-Safe's reference to a source does not transfer ownership or imply sponsorship.

13. Copyright and Rights Complaints

A person who believes material on E-Safe infringes copyright or another protected right may send a detailed notice to legal@e-safe.us identifying the protected work, the exact E-Safe URL or material, the complainant's contact information, the basis of the claim, a good-faith statement, a statement under penalty of perjury that the information is accurate and the complainant is authorized to act, and a physical or electronic signature.

E-Safe may remove or restrict material, request additional information, notify the submitting user, restore material when appropriate, or terminate repeat infringers. False or materially misleading notices may expose the sender to liability. This complaint process does not waive any defense or represent that E-Safe has completed any optional registration required to claim a particular statutory safe harbor.

14. Privacy and Third-Party Providers

The Privacy Policy describes categories of Personal Information, cookies, retention, deletion, security, installed plugins, external services, and provider-policy links. A user's use of a third-party service is also subject to that provider's policies.

E-Safe does not control a third party's availability, content, data practices, security, or terms and is not responsible for loss arising from a third-party service. A provider may change, discontinue, or restrict its service without E-Safe's control.

15. Email and Electronic Communications

By providing an email address or using an account, a user consents to receive required account, password, security, operational, administrative, legal, and service-response messages electronically. Optional subscriptions may be changed through available preferences or unsubscribe methods.

A user is responsible for maintaining a working email address and checking spam or filtering settings. Email is not guaranteed secure, immediate, or successfully delivered. A notice sent to the account email address, posted in the account, or posted conspicuously on the website is effective when sent or posted to the extent allowed by law.

16. Suspension, Restriction, and Termination

E-Safe may refuse registration, limit visibility, remove content, suspend features, restrict communications, reset credentials, preserve evidence, or suspend or terminate access at any time when reasonably believed necessary for security, moderation, abuse prevention, legal compliance, operational capacity, source protection, or enforcement of these Terms.

Termination does not automatically require immediate destruction of all information. Account and Personal Information handling after termination follows the Privacy Policy, including verification, legal holds, security records, public-content limitations, and backup rotation. Sections that by their nature should survive termination remain effective, including licenses already exercised, intellectual-property rules, disclaimers, releases, indemnification, limitations, dispute provisions, and record-preservation rights.

17. Website Availability and Changes

E-Safe is provided as a privately funded public service. It may experience errors, outages, maintenance, capacity limits, lost data, delayed updates, source failures, cyberattacks, or permanent closure. E-Safe does not promise continuous operation, data recovery, feature preservation, response times, accessibility from every device, or compatibility with every browser or assistive technology.

Users are responsible for retaining copies of important information and using official services for time-sensitive or legally significant matters. E-Safe may change these Terms, the Privacy Policy, features, eligibility, access, or content at any time, subject to any notice required by the companion documents or applicable law.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-SAFE AND ALL CONTENT, USER CONTENT, DATA, LINKS, SOFTWARE, TOOLS, EMAILS, ALERTS, LISTINGS, VERIFICATIONS, SEARCH RESULTS, APPOINTMENTS, AND SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”

THE E-SAFE OWNER, OPERATOR, ADMINISTRATORS, VOLUNTEERS, CONTRIBUTORS, LICENSORS, SOURCES, AND SERVICE PROVIDERS, COLLECTIVELY THE “PROTECTED PARTIES,” DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, SECURITY, AVAILABILITY, COMPATIBILITY, RESULTS, AND FREEDOM FROM HARMFUL CODE.

No statement, verified status, moderation action, email, response, source link, or assistance creates a warranty, fiduciary duty, professional relationship, special duty, promise of protection, duty to investigate, or guarantee of outcome.

19. Assumption of Risk and Release

A user voluntarily assumes all risks connected with relying on information, communicating with another user, attending an event, meeting a person, exchanging a pet, contacting a listed business, using a public location, following a link, downloading a file, using an AI result, or acting on community, safety, medical, legal, financial, veterans, HOA, business, or public-record information.

To the maximum extent permitted by law, the user releases the Protected Parties from claims arising from disputes between users, third-party conduct, User Content, public-source content, external websites, meetings, transactions, injuries, losses, property damage, identity disputes, pet exchanges, or reliance on information, except to the extent a claim cannot lawfully be released.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROTECTED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, RELIANCE, PUNITIVE, OR ENHANCED DAMAGES; LOST PROFITS, REVENUE, SAVINGS, OPPORTUNITY, GOODWILL, DATA, USE, OR REPUTATION; PERSONAL INJURY OR PROPERTY LOSS ARISING FROM THIRD-PARTY OR USER CONDUCT; OR COSTS OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ALL PROTECTED PARTIES FOR ALL CLAIMS ARISING FROM OR RELATING TO E-SAFE, THE SERVICES, THESE TERMS, OR THE PRIVACY POLICY WILL NOT EXCEED THE GREATER OF THE AMOUNT THE CLAIMANT PAID DIRECTLY TO E-SAFE FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT OR ONE HUNDRED UNITED STATES DOLLARS. BECAUSE PUBLIC SERVICES ARE PROVIDED WITHOUT CHARGE, THE APPLICABLE CAP WILL ORDINARILY BE ONE HUNDRED DOLLARS.

These limitations apply regardless of legal theory and to the fullest extent allowed by law. They do not exclude liability that applicable law does not permit to be excluded.

21. Indemnification

To the maximum extent permitted by law, a user agrees to defend, indemnify, and hold harmless the Protected Parties from claims, demands, investigations, liabilities, judgments, losses, penalties, damages, and reasonable attorneys' fees and costs arising from the user's User Content, conduct, account, violation of these Terms, violation of law, infringement of rights, unauthorized submission of another person's information, dispute with another person, or misuse of E-Safe.

E-Safe may control the defense and settlement of an indemnified matter. The user may not settle a matter in a way that admits wrongdoing by, imposes an obligation on, or restricts a Protected Party without written consent. This section does not require indemnification to the extent prohibited by law.

22. No Professional or Special Relationship

Use of E-Safe does not create an attorney-client, doctor-patient, adviser-client, fiduciary, employment, agency, partnership, joint venture, insurer-insured, investigator-client, government-benefit, or other professional or special relationship. E-Safe has no duty to monitor a user, warn a particular person, preserve evidence, investigate a report, verify a source, or take action for the benefit of a specific user unless a nonwaivable law expressly requires it.

23. Governing Law and Exclusive Chatham County Venue

These Terms, the Privacy Policy, and every dispute arising from or relating to E-Safe are governed by the laws of the State of Georgia, without applying a choice-of-law rule that would select another jurisdiction's law, except where federal law controls.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERY CLAIM, ACTION, OR PROCEEDING MUST BE FILED AND MAINTAINED EXCLUSIVELY IN A STATE COURT OF COMPETENT JURISDICTION LOCATED IN CHATHAM COUNTY, GEORGIA, OR, WHEN EXCLUSIVE FEDERAL JURISDICTION EXISTS, IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF GEORGIA, SAVANNAH DIVISION. EACH USER IRREVOCABLY CONSENTS TO PERSONAL JURISDICTION AND VENUE IN THOSE COURTS AND WAIVES OBJECTIONS BASED ON INCONVENIENT FORUM, RESIDENCE, OR DISTANCE, TO THE EXTENT THE WAIVER IS ENFORCEABLE.

24. Jury Trial and Class Action Waivers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES A TRIAL BY JURY FOR A DISPUTE ARISING FROM OR RELATING TO E-SAFE, THESE TERMS, OR THE PRIVACY POLICY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A CLAIM MAY BE BROUGHT ONLY IN THE CLAIMANT'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, PRIVATE ATTORNEY GENERAL, OR PARTICIPANT IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. A COURT MAY NOT COMBINE CLAIMS OF DIFFERENT USERS WITHOUT THE EXPRESS WRITTEN CONSENT OF ALL PARTIES.

25. Time Limit for Claims

To the maximum extent permitted by law, a claim arising from or relating to E-Safe, these Terms, or the Privacy Policy must be filed within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim. A claim filed later is permanently barred. This section does not shorten a limitations period that applicable law does not permit the parties to shorten.

26. Equitable and Protective Relief

Unauthorized access, scraping, misuse of credentials, disclosure of restricted information, infringement, harassment, or interference with security may cause harm that cannot be adequately remedied by money. E-Safe may seek temporary, preliminary, permanent, or other equitable relief in a court of competent jurisdiction without waiving any other remedy and, to the extent permitted by law, without proving actual damages or posting bond.

27. Changes to Ownership, Operation, or Closure

If responsibility for operating E-Safe changes, the website is transferred, the owner becomes unable to continue, hosting or control changes, or the website closes, E-Safe may assign or transfer these Terms and related operational rights to a successor. Personal Information will be handled as described in the Privacy Policy.

A user may not assign an account, these Terms, or any right against E-Safe without written consent. E-Safe may close the website or discontinue any Service without liability, subject to nonwaivable law.

28. Changes to These Terms

E-Safe may update these Terms to reflect changes in Services, law, security, providers, or operations. The updated version will display a revised effective date.

For a material change, E-Safe will provide reasonable notice before the change takes effect when practical through a website notice, account notice, or email. Continued use after the effective date constitutes acceptance. A user who does not accept the updated Terms must stop using the Services and may request account deletion under the Privacy Policy.

29. General Provisions

If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. If the jury or class waiver is unenforceable for a particular claim, only that claim proceeds without the unenforceable waiver and all remaining provisions continue.

E-Safe's failure to enforce a provision is not a waiver. Headings are for readability and do not limit meaning. “Including” means “including without limitation.” Electronic records and acknowledgments may be used to prove acceptance. These Terms and the Privacy Policy constitute the entire agreement concerning public use of E-Safe, except for an additional written agreement expressly signed by the owner.
