Update: Georgia Homeownership Protection Act (HB 1035)

Georgia’s proposed Homeownership Protection Act (HB 1035) was introduced during the 2026 legislative session to prevent owner occupied homes from being forced into foreclosure over HOA assessments and similar non tax debts. Since its introduction, however, another measure, Senate Bill 406, has emerged as the primary HOA reform bill moving through the Georgia General Assembly. This update explains the current legislative status of HB 1035, outlines the major provisions of both HB 1035 and SB 406, and examines how the two bills differ in approach. The article also explores what may happen if SB 406 advances while HB 1035 remains stalled, including the possibility that the stronger homeowner protections proposed in HB 1035 could remain dormant during the current session.
